These Terms of Service ("Terms") govern your access to and use of the PointShift platform. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
PointShift provides tools to build, customize, and operate online stores, including an optional flow to import branding and products from a connected Instagram business account. We may add, change, or remove features over time.
You must provide accurate information and are responsible for safeguarding your account credentials and for all activity under your account. You must have authority to act for any business you represent on the platform.
When you connect an Instagram or Facebook account, you authorize us to access and process the related data described in our Privacy Policy on your behalf. You must own or be authorized to manage any account, Page, or catalog you connect, and your use must comply with Meta terms and policies.
You agree not to misuse the service, including by violating laws, infringing the rights of others, uploading harmful or unlawful content, attempting to gain unauthorized access, or interfering with the operation or security of the platform.
You retain ownership of the content and data you provide or import. You grant us the limited rights needed to host, process, and display that content to operate your store. You are responsible for the legality and accuracy of your content and products.
The PointShift platform, including its software, design, and trademarks, is owned by us or our licensors and is protected by law. These Terms do not grant you any rights to our intellectual property except as needed to use the service.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, PointShift will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service.
You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the platform or other users. Upon termination, certain provisions survive, including ownership, disclaimers, and limitations of liability.
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which PointShift operates, without regard to conflict-of-laws principles.
